Please read these terms carefully before using the howay.ai platform.
1. Introduction
These Terms of Service (“Terms”) govern access to and use of the howay.ai platform (“Platform”, “Service”) operated by Howay AI Ltd. (“Company”, “we”, “us”, “our”).
By accessing or using the Platform, users agree to comply with these Terms. If you do not agree, you may not use the Service.
The Platform is designed to support teachers, schools, parents and educational institutions in providing feedback on student writing.
2. Intended Users
The Platform is intended for:
- Teachers
- Schools and educational institutions
- Parents or guardians
- Students using the service under supervision of a school or guardian
Users under the age of 18 may only use the Platform through an authorised school, teacher, or parent account.
3. Educational Purpose
The Service is intended as an educational support tool.
The Platform:
- Provides automated feedback on student writing
- Supports teaching and assessment practices
The Platform does not replace teacher judgement and should not be used as the sole basis for grading or assessment decisions.
4. User Accounts
Users may be required to create an account to access certain features.
Users agree to:
- Provide accurate information
- Maintain the security of their login credentials
- Notify the Company immediately of unauthorised access
The Company is not responsible for losses caused by compromised accounts.
5. Acceptable Use
Users agree not to:
- Upload unlawful or harmful content
- Attempt to reverse engineer the platform
- Attempt to access other users' data
- Use the platform to generate harmful or misleading educational content
- Use automated scraping tools
The Company reserves the right to suspend accounts that violate these terms.
6. Intellectual Property
All software, algorithms, models, and platform functionality remain the intellectual property of howay.ai.
Users retain ownership of their uploaded educational content.
By uploading content, users grant the Company a limited license to process the content for the purpose of providing the Service.
7. AI Generated Feedback Disclaimer
The Platform uses artificial intelligence systems to generate feedback.
AI generated outputs may contain inaccuracies.
Users agree that:
- AI feedback should be reviewed by teachers or responsible adults
- The Company is not responsible for academic outcomes resulting from platform use
8. Data Privacy
Use of the Platform is subject to our Privacy Policy.
The Company processes data in accordance with:
- UAE Personal Data Protection Law (PDPL)
- GDPR and applicable international data protection regulations
9. Limitation of Liability
To the fullest extent permitted by law:
howay.ai shall not be liable for:
- Indirect damages
- Educational decisions based on AI output
- Service interruptions beyond reasonable control
Total liability shall not exceed the fees paid by the user within the previous 12 months.
10. Service Availability
The Company may modify, suspend, or discontinue parts of the Service at any time.
We will make reasonable efforts to provide notice where possible.
11. Termination
We may suspend or terminate accounts that violate these Terms.
Users may terminate their accounts at any time.
Upon termination, access to the platform may be revoked.
12. Governing Law
These Terms shall be governed by the laws of the United Arab Emirates.
Where applicable, disputes may be resolved under the jurisdiction of the relevant free zone authority or courts of the UAE.
13. Changes to Terms
We may update these Terms periodically.
Continued use of the Platform constitutes acceptance of updated Terms.
